Vala Equestrian is committed to protecting the privacy of its customers. Vala Equestrian is bound by the Privacy Principles set out in the Privacy Act 1993 (the “Act”). Vala Equestrian will only collect, use and disclose personal information in accordance with the Act and this Privacy Policy. 

By using this site you agree to the collection, use and disclosure of your information as described in this Privacy Policy. If you do not agree, please do not use the site. Vala Equestrian may amend this Privacy Policy at any time and for any reason. The updated version will be available on the site. Vala Equestrian may highlight changes on the site but you should check the Privacy Policy regularly for changes. In this Privacy Policy, “personal information” is as defined in the Act.  It includes your name and email address. 

1. HOW DOES VALA EQUESTRIAN COLLECT PERSONAL INFORMATION? 

Vala Equestrian collects personal information that is necessary for our business activities and in order to provide and develop our services and products. We may do this in a number of ways, including: 

directly from you, when you provide it to us or our agents or contractor; 

from publicly available resources; by analysing our own records of the site; or from third parties (where you have consented to such collection or as permitted by applicable law). 

Vala Equestrian may ask you to provide personal information (such as name, age, mailing address, phone number, email address and password) when you:  
- complete a survey; 
- participate in one of our competitions; 
- make a purchase online;
- connect via Facebook; or 
- contact us.  

Failure to provide necessary personal information when requested may result in certain website and/or other services not being available to you. 

2. MOBILE TERMS OF SERVICE. 

The Vala Equestrian mobile message service (the
"Service") is operated by Vala Equestrian (“Vala Equestrian”, “we”,
or “us”). Your use of the Service constitutes your agreement to these terms and
conditions (“Mobile Terms”). We may modify or cancel the Service or any of its
features without notice. To the extent permitted by applicable law, we may also
modify these Mobile Terms at any time and your continued use of the Service
following the effective date of any such changes shall constitute your
acceptance of such changes.
By consenting to Vala Equestrian’s SMS/text messaging service, you agree to
receive recurring SMS/text messages from and on behalf of Vala Equestrian
through your wireless provider to the mobile number you provided, even if your
mobile number is registered on any state or federal Do Not Call list. Text
messages may be sent using an automatic telephone dialing system or other
technology. Service-related messages may include updates, alerts, and
information (e.g., order updates, account alerts, etc.). Promotional messages
may include promotions, specials, and other marketing offers (e.g., cart
reminders).
You understand that you do not have to sign up for this program in order to
make any purchases, and your consent is not a condition of any purchase with
Vala Equestrian. Your participation in this program is completely voluntary.
We do not charge for the Service, but you are responsible for all charges and
fees associated with text messaging imposed by your wireless provider. Message
frequency varies. Message and data rates may apply. Check your mobile plan and
contact your wireless provider for details. You are solely responsible for all
charges related to SMS/text messages, including charges from your wireless
provider.
You may opt-out of the Service at any time. Text the single keyword command STOP
to Vala or click the unsubscribe link (where available) in any text message to
cancel. You'll receive a one-time opt-out confirmation text message. No further
messages will be sent to your mobile device, unless initiated by you. If you
have subscribed to other Vala Equestrian mobile message programs and wish to
cancel, except where applicable law requires otherwise, you will need to opt
out separately from those programs by following the instructions provided in
their respective mobile terms.

We may change any short code or telephone number we use to operate the Service
at any time and will notify you of these changes. You acknowledge that any
messages, including any STOP or HELP requests, you send to a short code or
telephone number we have changed may not be received and we will not be
responsible for honoring requests made in such messages.
The wireless carriers supported by the Service are not liable for delayed or
undelivered messages. You agree to provide us with a valid mobile number. If
you get a new mobile number, you will need to sign up for the program with your
new number.
To the extent permitted by applicable law, you agree that we will not be liable
for failed, delayed, or misdirected delivery of any information sent through
the Service, any errors in such information, and/or any action you may or may
not take in reliance on the information or Service.

3. PASSIVE INFORMATION COLLECTION 

As you navigate through the Vala Equestrian website, certain information can be passively collected (that is, gathered without you actively providing the information) through various technologies, such as cookies, internet tags or web beacons and navigational data collection. Vala Equestrian may use and combine such passively collected anonymous information to provide better services to site visitors, customise the site based on your preferences, compile and analyse statistics and trends and otherwise administer and improve the site for your use. 

4. USE OF PERSONAL INFORMATION 

The personal information we collect from you may be used by us (and our employees, officers, agents and contractors) and our related companies for the following purposes:  ◯ to answer any of your queries or otherwise contact you if necessary; ◯ to allow you to participate in our competitions and other promotions; ◯ to help us learn more about the visitors to our site so that we can improve your Vala Equestrian experience and our business; ◯ to address problems with the site, our business or our products and services; ◯ to provide you with information about sales, promotions, and products from Vala Equestrian and carefully selected third parties; ◯ to develop and maintain our relationship with you and generally to do business with you; and ◯ any other purpose disclosed to you at the time your personal information is collected.  In addition, you can sign up to receive emails from Vala Equestrian which contain information about sales, promotions, news, and products from Vala Equestrian. By signing up to receive emails from Vala Equestrian, you consent to receiving our marketing materials, including by way of commercial electronic messages, for any of the purposes set out in this Privacy Policy. You may also receive marketing materials from our carefully selected third party partners. You have the right to unsubscribe to marketing materials at any time. 

5. DISCLOSURE OF PERSONAL INFORMATION 

Vala Equestrian will not disclose your personal information to any third parties except: to third parties appointed by Vala Equestrian, including our website hosting partner and advertising partner, who assist us to perform services (in which case Vala Equestrian requires these contractors to keep your personal information confidential and not to use or disclose it for any purpose other than the purpose of performing those services); where you have expressly consented, to carefully selected third party partners, so that they may inform you of offers, promotions and services; in the unlikely event that Vala Equestrian or its assets are acquired by a third party, the information may be provided to that third party; in exceptional circumstances, Vala Equestrian may be required or authorised by law to disclose personal information, for example to law enforcement authorities or to prevent a serious threat to public safety; or otherwise with your consent or where we believe it is appropriate to protect our rights. 

6. LINKS TO OTHER WEBSITES 

The site contains links to other (external) websites that may have privacy policies that differ from our own. Vala Equestrian is not responsible for the content of any external website. We encourage you to always review the privacy policies of external websites before providing any personal information. 

7. HANDLING OF PERSONAL INFORMATION 

Vala Equestrian will take reasonable steps to protect all personal information held by it from misuse, loss, unauthorised access, modification or disclosure. 

8. ACCESSING YOUR PERSONAL INFORMATION 

You may seek access to, and correction of, personal information that Vala Equestrian holds about you and we will provide access to that information in accordance with the Act.
